Welcome to Holy Pause. By downloading, accessing, or using the Holy Pause mobile application, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the app.

1. Acceptance of Terms

By using Holy Pause, you confirm that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• You will use the app in accordance with these Terms and all applicable laws
• You have read and understood our Privacy Policy

2. Description of Service

Holy Pause is a mobile application designed to help users:

• Reduce screen time and digital distractions
• Create intentional moments for prayer and spiritual reflection
• Block selected apps during designated holy pause times
• Develop consistent daily prayer habits

The app operates primarily on your local device and uses Apple's Screen Time API to manage app blocking.

3. User Responsibilities

3.1 Appropriate Use

You agree to use Holy Pause:

• For personal, non-commercial purposes
• In a manner consistent with all applicable laws and regulations
• In accordance with the spiritual and respectful nature of the app

3.2 Prohibited Activities

You agree NOT to:

• Reverse engineer, decompile, or disassemble the app
• Remove, disable, or circumvent any security features
• Use the app for any unlawful or harmful purpose
• Attempt to gain unauthorized access to any part of the app
• Share or distribute the app outside of official app stores
• Use automated systems or software to extract data from the app

4. Subscription Terms

4.1 Free Tier

Holy Pause offers a free tier that includes:

• Full app functionality with app blocking and prayer features
• Advertising displayed before prayer sessions
• All core features available indefinitely

4.2 Premium Subscription

Premium subscriptions include:

• Ad-free experience
• Enhanced prayer content
• Priority support

4.3 Billing and Renewal

• Subscriptions are processed through Apple's App Store
• Payment is charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• Subscriptions can be managed and auto-renewal can be turned off in your App Store Account Settings

4.4 Free Trials

• Free trial periods, if offered, allow you to try premium features before being charged
• Any unused portion of a free trial period will be forfeited when you purchase a subscription
• Free trials are available only once per user

4.5 Refunds

• All purchases are processed through Apple's App Store
• Refund requests must be made directly to Apple
• We do not have the ability to process refunds directly

4.6 Restore Purchases

You can restore previous purchases using the "Restore Purchase" button in the app. This is handled entirely through Apple's systems and does not require an account.

5. Intellectual Property

5.1 App Ownership

Holy Pause, including its design, code, content, branding, and all related intellectual property, is owned by Holy Pause and is protected by copyright, trademark, and other laws.

5.2 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and use the app on your personal iOS device
• Access and use the app's features for personal spiritual development

5.3 User Content

You retain ownership of any notes, prayers, or content you create within the app. However:

• All user content is stored locally on your device only
• We do not have access to your content
• You are responsible for backing up your content if desired

6. Third-Party Services

Holy Pause integrates with third-party services including:

• Apple Screen Time API: For app blocking functionality
• Google AdMob: For serving advertisements
• RevenueCat: For subscription management
• Mixpanel: For analytics

Your use of these services is governed by their respective terms of service and privacy policies.

7. Disclaimers and Limitations of Liability

7.1 Spiritual Guidance Disclaimer

Holy Pause is a tool for personal spiritual development. It is not:

• A substitute for pastoral counseling or spiritual direction
• Professional mental health or medical advice
• Affiliated with any specific church, denomination, or religious organization

If you are experiencing mental health concerns, please seek professional help.

7.2 Service "As Is"

The app is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free operation

7.3 No Guarantee of Results

While Holy Pause is designed to help users develop prayer habits and reduce screen time, we do not guarantee:

• Specific spiritual outcomes
• Complete elimination of distractions
• That the app will meet all your expectations

7.4 Technical Limitations

Holy Pause relies on Apple's Screen Time API. We are not responsible for:

• Changes to the Screen Time API by Apple
• iOS updates that may affect app functionality
• Device-specific compatibility issues
• User circumvention of app blocking features

7.5 Limitation of Liability

To the maximum extent permitted by law, Holy Pause and its creators shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Service interruptions or data loss
• Any damages arising from your use or inability to use the app

Our total liability shall not exceed the amount you paid for the app in the 12 months preceding the claim (or $50 if using the free version).

8. Indemnification

You agree to indemnify and hold harmless Holy Pause, its creators, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the app
• Your violation of these Terms
• Your violation of any rights of another person or entity

9. Modifications to Service and Terms

9.1 Service Modifications

We reserve the right to:

• Modify or discontinue any feature of the app
• Update pricing for future subscribers (existing subscriptions are honored)
• Change the frequency or type of advertisements

9.2 Terms Modifications

We may update these Terms from time to time. We will notify you of material changes by:

• Updating the "Last Updated" date
• Providing an in-app notification
• Requiring acceptance of new terms before continued use

Your continued use of the app after changes constitutes acceptance of the new Terms.

10. Termination

10.1 Termination by You

You may stop using the app at any time by:

• Uninstalling the app from your device
• Canceling your subscription (if applicable)

10.2 Termination by Us

We reserve the right to suspend or terminate your access to the app if:

• You violate these Terms
• You engage in fraudulent activity
• Required by law

10.3 Effect of Termination

• Upon termination, your license to use the app ends immediately
• Locally stored data will remain on your device until you uninstall
• No refunds will be provided for unused subscription time

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States, without regard to conflict of law principles.

11.2 Dispute Resolution

For any disputes arising from these Terms or use of the app:

• If informal resolution fails, disputes will be resolved through binding arbitration
• Arbitration will be conducted by a neutral arbitrator in accordance with applicable arbitration rules

11.3 Class Action Waiver

You agree to resolve disputes with us only on an individual basis, and not as part of any class, consolidated, or representative action.

13. Age Requirements

Holy Pause is intended for users aged 13 and above. Users under 18 should have parental or guardian consent to use the app.

14. International Use

Holy Pause is available worldwide. You are responsible for compliance with local laws regarding use of the app in your jurisdiction.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Holy Pause regarding use of the app.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

17. No Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
